1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Buyer's Mate website located at buyersmate.com.au and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Important Disclaimer - General Information Only
The information provided through our Service is general in nature and is intended for informational purposes only. It does not constitute professional financial, investment, legal, tax, or real estate advice.
Buyer's Mate does not hold an Australian Financial Services Licence (AFSL) and does not provide financial product advice as defined under the Corporations Act 2001 (Cth). Our property assessments, suburb analyses, and related information:

3. Description of Service
Buyer's Mate is a property research and intelligence platform designed to help home buyers and property investors make more informed decisions. Our platform provides:
- AI-powered suburb analysis evaluating growth factors, demographics, and market trends
- Property assessment reports using our proprietary scoring methodology
- Market insights and suburb comparisons
- Educational resources about property research and investment considerations
We are not a buyer's agent, real estate agency, property valuer, or financial advisor. We do not buy, sell, lease, or negotiate properties on your behalf. We do not provide formal property valuations, appraisals, or financial advice. Our role is to provide research tools and data analysis to support your own decision-making process.
4. Data Sources and AI Technology
Our platform aggregates and analyses data from various publicly available and government sources, including but not limited to:
- Australian Bureau of Statistics (ABS) census data
- State and territory government land registries and cadastral data
- Publicly available property listing information
- Government infrastructure and planning announcements
- Crime statistics from state police services
- Other publicly accessible data sources
We apply artificial intelligence and machine learning algorithms to analyse this data and generate insights. Our AI models assess multiple factors to produce suburb ratings and property scores. However, AI-generated analysis has inherent limitations:
- AI models are based on historical data and cannot predict future market movements
- Algorithms may not capture all relevant factors affecting property values
- Data from third-party sources may contain errors or be outdated
- Market conditions can change rapidly and unexpectedly
Our assessments represent one perspective based on available data and should be used as one input among many in your research process.
5. Accuracy of Information

- Credits are non-refundable once purchased, except as required by Australian Consumer Law
- Subscriptions will auto-renew unless cancelled before the renewal date
8. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Transmit harmful, offensive, or illegal content
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers

9. Intellectual Property

10. Limitation of Liability
To the maximum extent permitted by law, Buyer's Mate, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or anticipated savings
- Loss of data or goodwill
- Property purchase decisions made based on our information
- Any errors, inaccuracies, or omissions in our content
- Interruption or unavailability of the Service
Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
If we breach a consumer guarantee that cannot be excluded, our liability is limited to (at our option): resupplying the services or paying the cost of having the services supplied again.
12. Indemnification
You agree to indemnify and hold harmless Buyer's Mate and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that we are not liable for any damage or loss caused by your use of such third-party content or services.
14. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time by contacting us.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website with a new "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising from these Terms or your use of the Service.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Buyer's Mate regarding the use of the Service and supersede all prior agreements and understandings.
